Terms and Condition

1. Acceptance of Terms
1.1. Please read and understand these Terms and Conditions before using our website or booking our services. By accessing our website or purchasing services, you indicate your acceptance of these Terms and agree to comply with all applicable laws and regulations.
1.2. JKD STUDIO maintains this website and its contents for the use of customers, employees, and the general public.
1.3. We reserve the right to modify or update these Terms at any time without notice. Continued use of our website or services constitutes acceptance of such changes.
1.4. JKD STUDIO is not responsible for any costs associated with installation, removal, or repair of damages incurred by the client or end-user.

2. General Conditions
2.1. We may refuse service to anyone at any time, for any reason.
2.2. Product previews are illustrative only and may vary in appearance due to screen settings, lighting, or other factors. We cannot guarantee exact replication but ensure high-quality products.
2.3. You agree not to copy, distribute, sell, or reproduce any part of our services or website without prior written consent.
2.4. All information on this site is provided for general purposes and may not be complete, accurate, or up-to-date. We reserve the right to modify content, products, or prices without notice.

3. Customer Obligations
3.1. Customers must provide accurate and complete information when booking.
3.2. The Event Booking Form must be completed at least 7 days prior to the event. All information provided in this form is important for planning and ensuring the smooth running of your event.
3.3. Customers must use services and hired items for lawful purposes only.
3.4. Hired items must be handled with care and returned in their original condition. Damage or breakages may result in deductions from the refundable bond or additional charges.
3.5. JKD STUDIO services are intended for private events only. Commercial use requires prior written approval.

4. Booking and Payment
4.1. To secure an event booking, a non-refundable deposit of 50% of the total service fee is required.
4.2. Full payment must be made at least 7 days prior to the event.
4.3. A refundable bond may be required to cover potential damages or missing items.
4.4. Bond refunds will be made via bank transfer within 5 business days after assessment of hired items. Refunds will be issued to the account details provided in your Event Booking Form. JKD STUDIO is not responsible for incorrect bank details provided by the client.
4.5. Bookings are only confirmed once payment is received and the Event Booking Form is completed.
4.6. Once a deposit payment is made from our invoice, you are acknowledging and agreeing to all terms and conditions set out in the invoice and within this document.
4.7. Failure to pay any invoice by the due date may result in legal proceedings being initiated. JKD STUDIO reserves the right to issue a solicitor’s Letter of Demand for outstanding payments. All legal or recovery costs incurred in this process will be added to the client’s final invoice balance and are payable in full.
4.8. Quotes and invoices are valid for 7 days from issue. Prices may change after this period.
4.9. Requests for changes or customisations must be submitted at least 7 days prior to the event. Late requests may incur additional fees.

5. Delivery and Pickup
5.1. Delivery and pickup will occur as stated in your Booking Form.
5.2. Additional fees may apply if significant changes occur during setup that affect staffing or logistics.
5.3. Any additional charges will be deducted from the bond or billed separately if the bond is insufficient.
5.4. Customers must ensure proper access, space, and safety for setup and pack-down.

6. Refunds and Cancellations
6.1. Refunds are not provided for change of mind.
6.2. Cancellations may be considered on a case-by-case basis at our discretion.
6.3. The 50% deposit is non-refundable under all circumstances.
6.4. Bookings cancelled less than 2 weeks before the event result in 50% forfeiture of the total service fee.
6.5. Postponements require at least 2 weeks’ notice and are subject to availability. Rescheduled events must occur within 6 months.
6.6. Any approved refunds will be issued via bank transfer within 10 business days.

7. Hirer Responsibilities
7.1. All hired items must be returned in the same condition as received.
7.2. Damage or missing items may result in bond deductions or additional charges at market value.
7.3. Dry hire backdrops (wood/MDF) must be protected from weather; JKD Studio is not liable for weather-related damage.
7.4. The hirer must provide suitable transport and take precautions to prevent damage during transport.
7.5. JKD STUDIO provides necessary hardware and support for backdrops; the hirer is responsible for safe installation and use.
7.6. The hirer assumes all risks associated with the use of hired items, including injury or property damage.

8. Weather Conditions
8.1. Hired items may not be suitable for adverse weather.
8.2. Outdoor items must be moved under cover or indoors during rain.
8.3. Additional cleaning or drying fees may apply for weather-related damage.
8.4. Plan B arrangements are the responsibility of the client.
8.5. Postponement due to weather requires 2 days’ notice and is subject to availability.

9. Privacy and Use of Information
9.1. Information provided in the Booking Form is essential for event planning and smooth execution.
9.2. JKD STUDIO does not sell, distribute, or share your information under any circumstances.
9.3. By completing the Booking Form, you consent to the use of photos or videos of hired items for promotional purposes unless otherwise requested in writing.

10. Liability and Indemnity
10.1. JKD STUDIO is not liable for indirect, incidental, or consequential damages.
10.2. The hirer indemnifies JKD STUDIO against claims arising from misuse, negligence, or violation of these Terms.

11. Governing Law
11.1. These Terms are governed by the laws of New South Wales, Australia.
11.2. Disputes are subject to the jurisdiction of the courts of New South Wales.
